39 in a 35 is rough.

Over is over ... but I'm guessing:

1. department is broke and needs revenue
2. cop is having a bad day
3. a pedestrian got hit in the area recently

You rarely see tickets for 1 or 2 mph over. Weather and equipment positioning screw with readings.

In this economy every department is revenue collecting so peg the posted limit and stick to it or you will get tagged.

With that in mind, over is over...sucks but it doesn't say ~35mph does it? If not then there is your answer legally speaking.

Totally lame.

I got pulled over for 73 in a 70 in Texas last December, but got "let go with a warning." I think anything for 5 or less over is an asshole/power trip move, 6-9 is questionable, and 10+ is legit. I personally try to stay in the 6-9mph over range if conditions permit, as I find it to be the best compromise between getting there quickly and not getting any tickets. Haven't had a speeding ticket since 2005 (knocks on wood).

I got pulled over by NOPD two weeks ago for "taking a turn too fast". It was a 25 and I was clocked doing 26. He really was trying to write me a ticket for it, too.

He changed his mind, I guess. I took the turn at an extremely comfortable speed, and I drive a freakin' stock fit. There were people blowing by me that didn't even get a second look. It was probably just because of my IL plates. As soon as he saw I had lived down here for the past 4 years it was all gravy.

NOPD be crazy.

I'm not sure how other states work, but in NC, individual Departments don't get a cent of the money from citations. We get an annual budget from the County every year. The only time our town (not Department) makes money is from issuing a Town Citation. But like I said, that money goes to the Town, not the Department. And again, that's just in my state/county

I didn't get any ticket, just posting a hypothetical question/situation and that response to Robaire was copied and pasted from another forum.

Cop is doing his job, but also being a jerk. Unless he pulls you over for a warning and then you give him attitude and he gives you a ticket. Then he's fully justified.

I fight most of my speeding tickets in court (or at least show up for a plea deal). I've had a bunch

:edit: the city of Denver openly admitted last year (or the year before?) that they were increasing speeding enforcement due to city revenue issues. Warned people via the news and everything.
