going 39 in a 35. Cop is anal or Cop is just doing his job?

Doing his job anally? Dunno, gotta be doing around 6mph over here before you need to be all that concerned about being pulled over...

Over is over. Just because you think there's an unwritten rule that lets you go over the speed limit a little bit doesn't mean the cop has to follow it. The speed limit is the law and if you choose to go over, you should take responsibility.

sheep like you are the problem with society today. We all have the right to defend ourselves in court, and are assumed innocent till proven guilty, it is one of the god given rights of living in this country called the United States of America. I would rather see someone actively participate and make sure that the different branches of government are following checks and balances then to just see someone roll over and take it. Complacency does nothing but add to the erosion of our already shrinking civil rights.

Going after both...

Exactly...I know a cop has a right to pull me over at 66 in a 65, however, YES you absolutely have the right to fight it...I draw the line when you KNOW you were breaking the law (people that roll through stop signs yet still say FUCK THE POLICE...I was safe to pass through).
Phat, your immediate attack on him in that regard is somewhat unwarranted. You yourself said in your post... 39 in a 35 cop anal or doing their job. They are doing their job. Reverse it around...relate it to your job. They are hired to uphold the law, and if the law is 35 then it is 35.

With that...I always cruise about 4-6mph above. h:

It's a legal stop and legal ticket...but as a cop, I wouldn't write for that. But that's why we have discretion

Yes, you have a right to fight it. I didn't say you couldn't or shouldn't fight it. People get off on technicalities all the time. Doesn't mean it's right. Driving is a privilege, not a right, and if you don't follow the rules you said you would follow when you got your license, there should be consequences.

I would certainly fight it and see if you can do something to avoid it being put on your record. Although you may have been speeding, it's a shame to potentially increase your insurance costs on account of a 4-over ticket.

Locally, you can take a traffic school class and they will wipe the ticket.
