Just take it to your insurance as they know all the legality issues involved. You pay your premiums for full coverage, put it to good use. You have his plate and pictures. Let them handle it, not worth your headache.

Actually they do write tickets in private parking lots because this happened to me and the cop was right there when it happened, he just pulled up and aksed did I want to file a report. I told him no since the guy had insurance but he gave me copies of the report form anyway just in case. I would give the guy one more shot and tell him that if he doesn't want to pay up then you will get insurance and the cops involved, and that means higher rates for him and possibly points on his license if you take it all the way to court. You wanna be nice cause if it happens to you then you would want someone to be nice but it doesn't always work out that way.
My thing is, if he owns the local pharmacy (and we know how expensive medicine is) then why doesn't he just pay up and forget about it? If he was cheap then just take the lower estimate and be done with it? People are so crazy sometimes...

First of all if he didn't give you his information and took off which he did. It is consider a hit and run. Second you should claim it against his insurance, but notify your insurance too. Or notify your insurance and tell them you got witness and picture. Take your car to 20/20 Autobody on Gale just east of Azusa. They do great work. While its pricey it is the guys insurance that will pay for it. I live less then 1/2 a mile from that plaza on Hacienda Blvd.

Tell him he better pay up or you'll sue him and file that he hit and run which I believe is a felony. Tell him straight up if he wants to cooperate or does he want to do it the ugly way.

what does that have to do with anything? what is an attorney? someone who knows the laws surrounding a specific set of circumstances(and much much more). i'm sure that most of us that posted in this have been in a fender bender(even if it wasn't our faults) and so i'm sure we are educated on what we are or aren't capable of doing.

Because different areas do not have the same laws and telling him he can sue for this and that is nothing but fluff...He was asking for straight advice and people say sue him for hit and run etc.....When it comes down to it, they do not know what they are talking about.....I am trying to prevent bad advice here

well sure laws are different in every area and there is no substitute for a good lawyer but not everyone has the money to see one or a friend that is one. I personally never said anything about sueing my advice was more towards the fact that he was hit and the guy didn't leave his insurance information which i'm pretty sure is considered a criminal offense just about everywhere. if he wanted actual advice he could bank on he shouldn't have posted a question here he should have consulted an attorney, nothing said here is set in stone...

Well, last saturday he reluctantly convinced me to go to with him to some ghetto shop on gale to get it fixed, but now you guys have changed my mind greatly - thanks.

Do I really have to get a police report? By the time I see him again it will be a whole week later.

Locals: Does anybody know the number to the local police department if he fails to cooperate and give me his info? I want to be ready when it happens.

The reason for the police report is that you'll have proof that he hit you when you make a claim against his insurance. There's no way they can deny that he hit you if the police say he did b/c he can turn it around anytime and tell his insurance that he has no idea what you're talking about.

Hey man get that report if you can cause you are being nice and doing HIM a favor by not involving his INC Co. but now hes being cheap and tryin to screw you!!
