Hit and run with injury does not make any diiference how small the injury according to CVC. It could just be a complaint of pain or a broken finger nail to a broken neck does not matter. I never said he should file a fraudulent claim. But a hit and run as a felony the police have more power to get this guy vs simple property damage.

Can you read, Hit and run with injury is a felony vs not a felony for simple property damage non injury. SWITERS defines injury as even a complaint of pain or someone who requests to be listed as injured. A felony hit and run gives the police more power and time to bring this scum bag to justice. Does not matter if he was parked and sitting in the back seat at the time. It only becomes fraudulent if he decides to milk the insurance company for $$ alot of people in traffic wrecks wished to be listed as injured and never file a claim for damages.

In that case your kinda up the creek. I would see what the DMV would do in this case. If the damage is more then $750 they will put this guys ass in the wringer

I fail to see the cop's logic... so when you report this to your insurance company, who's paying the deductible? You? Call your insurance company and raise holy hell.

The cop says since it is so little damage, the police aren't going to persue it
Does he work in a body shop? Who the hell is he to decide how much damage there is? Law enforcement's entire world is based on policies and procedures... I wonder why this one figures he doesn't have to follow them?

Damn, shit like this pisses me off. :madfawk:

you can also go get an estimate from someone you know (obviously to jack up the price) so its over $500 (thats the minimum here for a police report) then you can get his ass in trouble.
