cept im pretty sure i heard the reporter say witnesses said he resisted briefly prior to the video ... at least i think ... too lazy to watch video again 
and asides that ... it COULD happen that he grabbed the wrong weapon, IF there was a struggle, adrenaline and not thinking clearly he could have grabbed it and not realized ... the odds are slim but the odds of winning the lottery are slim too but it still happens

Even if it was an accident, how can you allow a guy like that to have a gun and even be able to make that mistake? Someone has to take the fall for this.

Did you watch the video that shows when the kid was shot? It was the 3rd video on the player I think. You can see the kid on the ground, 2-3 cops on him...then the one cop reaches for his gun, puts it in his back...fires. Other cops jump away.

I know an officer that was involved in a foot chase and accidentally drew the wrong weapon, got his service weapon instead of his taser and shot somebody. In the heat of the moment, things can go wrong...
having said that...I believe the cop that shot that guy knew he drew his Gun and intentionally shot the victim. I usually try to defend Cops, since I'm about to be one...but that Officer looked to me to be in the wrong and should face criminal charges on top of being terminated.
