Fla. jogger won't be charged for shooting teen

TAMPA, Fla. – A pistol-packing jogger in Florida won't be charged for shooting and killing a teenager who attacked him during a midnight run.

Prosecutors said Tuesday they are convinced Thomas Baker acted in self defense when he fired eight shots at 18-year-old Carlos Mustelier near Tampa in November .

Prosecutors say Florida's "stand-your-ground" law was a factor in their decision. The law, passed in 2005, gives people the right to use deadly force as long as they "reasonably believe" it is necessary to stop another person from hurting them.

Baker told police he reached for his gun when the teen punched him in the face. Baker has a concealed weapons permit.

The teen was hit four times in the chest, back and buttocks. He died at the scene.

although . . . and i hate to start the argument . . . but i don't know that i'd pull if someone simply punched me. that's a scary fine line to skirt. but i'm sure there were more circumstances than just he punched him

here in MI you be sittin in jail on murder charges if you shot while he was running away. no longer threat, no longer authorized deadly force

I'd pull, but not fire. What if he got you on the ground and found out you had a gun and pulled YOUR gun before you did?

oh i'd pull, you bet your ass . . . but i really don't see myself firing after one punch. like i said though we dont know the details. just given what the articles says i'd say he got a lil trigger happy.

now had he pulled after the kid punched him, warned him then the kid continued to advance . . . fuck yea all bets are off. but again, only two real ways to shoot someone in the ass / back . . .1. he's running away or 2. he's already on the ground, either way his back was to you. in either of those cases he's no longer a threat and therefor it goes from justified homicide / self defense to manslaughter. dude got lucky to get off with no charges imo

but i'd be willing to bet he will be facing a civil suit in the next few weeks or months from the victims family.

at the end of the day though, the real criminal is dead and the 'victim' is safe. had the gun not been there, had he not shot who knows how it would have ended. so props to florida and props to guns o:

Yeah that is on the line in my book just from the article I think that he could have gotten away. Running at midnight asking for trouble??

He has every legal right to run at any time he pleases, and probably shouldn't be considered in the argument.

I see this situation starting somewhat of an uproar. I would have pulled, and at the very most shot to wound. I don't know though, I haven't been in that position and who am I to say I wouldn't completely panic.

never shoot to wound, thats a dangerous dangerous scenario
