You'd definitely go to jail in CA, especially since there's no legal way to carry a loaded gun here - you shoot an attacker and you're not in or on your own property, they'll get you for illegal possession of a loaded firearm. Of course, this being CA, even if you're in your own house, they'll probably still arrest you.

eight shots is excessive even if only four hit. Why not just pull it out to scare him off. If he keeps coming shoot in the air. If he still keeps coming shoot him.

To scare him? If you are truly in fear for your life, the last thing on your mind is scaring someone.

Just pull it out to scare him off? Now that would have gotten him arrested. CCW is legal, brandishing a weapon is not. The only reason you can legally un-holster your weapon is if you are in danger and intend to use it.

And shoot in the air? You should really take some firearm safety classes. What would happen if one of those bullets comes down and kills a 12 year old?

And if anyone bothered to read what Spanks posted (I've only read 1/2 so far) 6 out of the 8 shots could have been in the time it takes for any human to stop shooting.

It's a really unrecognized phenomenon. When you delve into it a bit more, you realize that these people that fire off 6-8 shots in a matter of a second don't even realize they pulled the trigger that many times.

My 1911 mags only hold 7 rounds, the Sig P220 mags are 8 (I have two P220s), and the XD mags are 10 (I have one in .45acp and one in 9mm). I would probably have to carry all of them. I guess this is why the shotgun is my primary home defense weapon, better chance of getting a hit after firing off 7 shots in a few seconds. I only have two defensive shotguns though, I definitely need more.

If he shoots relatively straight up in the air and isn't in the lobby of a hotel, my physics tells me this can't happen.
