i would still consult your insurance to see if filing a claim in this instance would automatically increase your premiums. there are same cases they don't but it depends.

what kind of damage was done? i was in a not-at-fault accident just a few weeks ago and tried to keep our insurance peoples out of it since damages were less than $1k. but things went south real fast and i'm glad i still filed a claim w/ my insurance. eventually things worked out but i had some peace of mind knowing that if the other guy didn't pay up i'd be covered, not only for the immediate damages/repairs but also for anything that might possibly arise later

sorry to hear, though

it really shouldn't go up if wasn't your fault.

and like previously posted, if you use your insurance, you know it'll be taken care of and you won't have anything to worry about. and if you don't like the other guy, report it, because his shit will be going up because of it.

your rate will not go up since it is "not-at-fault".
if u do agree to let the other person pay with cash, make sure he/she is aware that you are going to take your car to the body shop of your choice and the car must be fixed completely to your satisfaction first. and they must also pay to cover the cost of a rental car while your car is in the shop too.
if u do agree to let the other person pay with cash, also make sure to write up a contract that he/she states it is their fault and both parties have decided to settle it with a cash payment of $xxxx. then have a photocopy of their drivers license and both of you sign it.

its just easier if everyone goes through insurance. especially since both of you have the same carrier.
