No disrespect to you Tony, but here's how it should have went down:

1) See damage
2) Take pics if possible
3) Call insurance to report damage and open a claim
4) Call guy and tell him you opened a claim, but see if he wants to settle outside of insurance

** Just because you open a claim does not mean you need to go through with it, it will only affect your rates if you cash out**

5) If he wants to settle outside of insurance, cool, get the cash and then close the claim. If he tries to dick you over and not pay, you have record of the incident with the insurance company.

Do not file this as hit and run, he had the decency to leave a note. As others said, I'm not waiting around for hours for you to come back out.

Heck, if I felt nice enough, maybe I'll call the police for you and file the report!

Oh, and you won't get the $1000 deductible from him (you may not have to pay it if his insurance company covers it, not sure), but you can't sue someone for a deductible that YOU chose to insure your car with... also, if it's old/cheap enough to put that high of a deductible on, why bother with full coverage?

If you hit a deer.. would you try and sue the deer for your deductible...?

I think the real issue here is....how the FAWK can you hit a parked car that hard? WTF?! I understand maybe misjudging while backing up and causing a little scrape, but that damage is just ridiculous.

skipped rest of thread to re-affirm this. I have been in 2 accidents where the guy who fucked my shit up was more than happy to pay to get my shit fixed than deal with insurance. He was the good guy so I gave him benefit and it always prevailed.
