say i found an iphone and i want to use it
would i encounter any obstacles with att and/or apple?

Do you currently have AT&T service? If so, I think you can swap the SIM and nobody will notice.
I wouldn't reactivate the unit though AT&T.

They're S/N tagged, so if it's "lost", it'll come up in the AT&T system.
If you unlock it and use it with TMobile (whomever) the phone is non-existent to them.
