i was in a car accident and i really dont know what to do next. it wasnt my fault and my car is totalled it was a clean ass 01 gsr. my passengers and i walked away. i want to sue them but how much could i get or sue for? should i wait for their insurance to give me an estimate before i get a lawyer? and what if the estimate is too low? i seriously have never sued anyone but i know i have to give a certain percentage to the lawyer right?

 

Talk to a lawyer. Lawyers usually take anywhere from 10%-33% of the total monetary settlement, depending on the claim.

the other party's insurance company will be responsible for the value of your totaled car. sorry to break the news to you (especially after a loss), but a "clean ass gsr" to you is still "a regular acura integra gsr" to anyone else. sentimental value is never a factor in calculating the value of a totalled vehicle. unless the other party's insurance coverage is too low (as in if they only had like $5k for property damage liability), you're not gonna be suing anybody. as long as the other party's insurance is sufficient in covering the total value of your car, you dont really have much to "fight".

Unless someone in your car was injured, don't be an asshole and sue. Shit happens, deal with it.

 

yea their insurance company should pay for everything.... make sure you get what the car is worth.............. also ask to see if you can buy it back.......

 

thanks guys. yea i knew i only had little to fight with but this is the story...3 parties involved, party 1 causes a crash with party 2 (who i was travelling behind) and then cause my car to crash to them cuz i couldnt avoid hitting them. i only had a split second to slammed on the brakes going 60mph. imagine passing a hill just to see two cars crashing 100ft in front of you at an intersection while you're travelling 60mph...

one more question...i hit the car that was at fault so can she sue me?

 

If the car is totaled, and the responsible party's insurace company cuts a check, that car is no longer his property.

Anything attached to the car at the time of estimate cannot be removed.
