car accident questions?

dude, if you get into a car accident, they can't sue you directly, they sue your insurance company. as long as your coverage is good enough, your policy will pay up to whatever limits you chose. based on how you described the accident, you might be at fault for the rear end damages of the car you hit and possibly a portion of their medical bills since they may or may not be able to prove that you were responsible for the injuries in the car that you hit. the car in front wasn't at fault, the middle car rear ended the first car, and you hit the middle one, like I said, you'll probably be liable for the rear damages of the second car.

accidents happen all the time. someday, you too might hit somebody. would you want them to sue you if the worst of the outcome was a smashed car? not worth it.

YES SHE CAN. It happend to my friend. He was between 2 cars. He hit first car and the car behind him hit him. He sued the car that hit him and got some money.

subrogation. (sp?). your own insurance company will pay out damages to the car YOU hit. then try to attempt to be reimbursed by the insurance company of the guy that hit you.

ITS YOUR FAULT FOR NOT LOOKING OUT FOR THE CAR AND YOU WILL BE SUED IF THE PERSON YOU HIT WANTS TO.

It doesn't matter if you had enough time to break or what not. Judge will say you should have been paying attention and going slow.

end of story.

yeah, the violation here would be "following too closely" and they might get you on "failure to reduce speed to avoid an accident" and if you really push the officers buttons, "speed not reasonable and prudent" and in NY state, if you're in an accident where your passengers could've gotten hurt, regardless of the circumstances, the officer can write you on reckless driving.

so if you didnt get hurt and you didnt get any tickets, count your blessings. then, sweep up the broken glass see what you have to do about either fixing your car or getting a new one.

^ nah i didnt rear end anybody, but yea i should of explained it better.
here's the story:

i was travelling on a 4 lane hwy, 2 north and 2 south. i was going 60mph 4-5 car lengths behind a girl (party 2) who was doing about 65-70mph. we go up a hill and theres an intersection. some lady (party 1) on the other side of traffic doesnt yield and makes a left turn and hits the girl in front of me. party 2 spins out all the way to the other side of traffic and party 1 spins out in the middle of my traffic and infront of me. i only had a second so i slammed on the brakes but i hit her. i didnt want to collide but then again i could not avoid it either. it was too fast and with that speed it would of been impossible to stop in time.

all this talk about suing is pissing me off.

and why the hell would you want to sue both parties if it's "party 1" that caused that accident?
