Damn tickets!
i had a cat-back system on my civic and i got pulled over and was told to change it and it wasnt loud at all. i ended up buying a stock rear section and bolted it to the piping. i was in court for no more than 10 minutes. all the dude did was ask me if the stock muffler was on and i said yes and he told me to leave.

On thursday i'm going to head over to the library, and look up the ordinance if there is one. On the site that cowanpp gave me there is no such ordinance, so I think the cop made a mistake. If there's a mistake on ticket involving the violation, I don't see why the ticket should not be thrown out. The bottom line is he pulled me over because my car looks souped up. If it wasn't the exhaust he would've found some other bs.

Unless there was a decibel reading, he wasn't in violation of Mt. Vernon law. I don't know about general New York law, but if it is worded anything like that first section of the Mt. Vernon statute (the catch-all phrase) I'd say he's got an easy 5th amendment void for vagueness challenge to it. Can't have a subjective standard of loud, has to be definable and measurable so us lowly citizens can conform our behavior. Subjective standard doesn't do that.

The city where I work (which is about 10 minutes away from MV) had similarly worded laws regarding noise ordinances, and people are written and convicted for violating it on a regular basis. If a reasonable person would consider it disturbing the peace, then you're guilty. It doesn't have to be spelled out specifically....its all based on the standard of reasonable objectiveness.
