yea, if he did, that would SUCK. they will look for ANYTHING and EVERYTHING on your car that can be deemed illegal.

That's not entirely true.

He can't search his car, sure; because there's nothing to give the Police Officer probable cause that there's anything worth finding inside of it. However, his modified exhaust *does* give him probable cause that there's Engine modifications, and he does have the right to make Joebenz open his hood.

In any case, this cop seems like a total dick. Do what he said, take it up with the judge.

Plead not guilty, go in and say that your exhaust is not modified before the catalytic convertor, therefor it is not violating any emission laws, and that it has not broken the 95db limit (according to the manufacturer) and further more, the Police had never tested your vehicle's exhaust's sound output to find out if it's below or above the 95db limit.

The Judge will throw it out. If he doesn't, tell him you demand that the Police properly test the sound output of your exhaust, and if it exceeds 95db (like it wont) that you will then remove the exhaust as the Fix-It ticket states.

Remember, you're innocent until proven guilty. They have to prove to you and the judge that it's louder than allowed, and by "ear" doesn't cut it. They have to measure it in a controlled enviornment.

Damn Joey, that sucks. A similar thing happened to me about a year and a half ago when I was leaving school. Go read up on the exhaust noise law, it was recently changed. They cannot prove to you that it is illegal, so go to court and fight it. I don't see any way they can enforce the 95db limit, because nobody offers the test...it is an SAE certified test, and nobody performs it. I also got a ticket for my AEM CAI, with the CARB STICKER ON THE INTAKE!! The cop just felt like being a dick and going on a power trip. He said I had to take it home or to a shop, and remove all the parts in question. If I got pulled over again, they would tow the car...f*uck that. So I had to go see the state ref, and he signed it all off for me after I passed the inspection and sniffer...went to the judge and got it cleared. Did you just get the exhaust ticket, or did you get a smog ticket too?

sucks. i got pulled over a long time ago for having "modified exhaust" before they really had a good law about it (anything different than stock was illegal). i have respect for cops, but sheriffs always piss me off.

ya, just got the exhaust ticket. i would have been so pissed if i got the smog ticket!! i passed smog last year with my shit!! and eddie can back me, :chuckles:

I believe you can go to a ref station and have them test it. Then take the paperwork to court. what a pain in the ass waste of time.

the thing in utah... only highway patrol will issue fix-it tickets.. all other tickets are non-moving citations and the fine can only be slighty reduced (note: like 10-20% reduction) if you show you've fixed it.. i got a 90dollar ticket for my old exhaust and tint and just paid it and left it at that.. they were both illegal, no reason fighting it.. your situation may be different.. also the fix-it ticket i got later for my tint was from UHP and my uncle signed it off for me and it didnt cost me a cent to get it cleared... utah has a pretty nice setup like that, however once im an officer, imma see what i can do to push the current laws to be more strict and bigger fines... :exnbp:

I think it was SCC or something...
