They could have, except that the Bugatti isn't built in the United States. The Altima is, and so is a lot of Nissans current products. Part of certifying the car is to confirm such things as horsepower figures etc. (although off HP numbers won't bar a car from certification, that would be plain stupid).
So, someone would find out about a 14HP loss very quickly, and that's a :nono: when you're in that playing field.

That's a pretty damn cool car...I'm not sure the point of it though. It's not really going to raise the status of VW or any company related to it (like the NSX did to Acura). I suppose they'll make a tidy profit, though...people will eat these puppies up.
