How do you clear out the spoiler's brake light

I don't understand why it's illegal w/ the spoiler brake lens being clear and the leds are still red? I can understand the whole rear lights being clear, but the spoiler lens? What's gonna be the big difference? What about spoiler w/out lens? Will the people w/ those get a fine? We're talking about spoiler brake light, not the 3rd brake light inside the rear window or it can be on the trunk...

Most cars these days have the third brake light already w/out the spoiler brake light... So clearing out the spoiler brake lense should be okay right?
