Exhibition of Speed
im kinda glad someone posted about this... on jan 23rd my brother took my car out for a ride when i was at work... i am 20 and he is 18 we both live at home, and that car is my ride to college which is 30+ miles away....
anyway, he takes the car out with one of his friends because i told him that i want to get a new one and that he could buy mine... he is driving do this street and a kid in a mustang passes him on the opposite side of the street and pulls a u-turn to catch up with him, my bro stops at a light and then goes all before the mustang comes up on him, the stang then drives by and about 1 minute later a cop pulls out right as my bro passes him, and pulls over the stang, my bro keeps going laughing that he got pulled over and then all of a sudden the cop comes and pulls him over too... its a "SPEED CONTEST" and they impounded both cars.... when i found out i was pretty pissed off seeing how my bro pretty much stole my car and then got it impounded... plus how the hell am i gonna get to school???? so we go straight from picking my bro up to the police office and talk to some lady cop that pretty much just yells at my bro but turns the car over because it was under my moms name... she said she would let us have the car because it was hers... if it would have been under my name she wouldnt have, then tells us to switch the name to mine...
we got the car out that day, but his court date is sometime at the end of this month... we'll see what happens to him

Cops are outrageous... good lord... I'm positive that cop had some quota to meet; maybe he's trying to make detective, needs to up his arrest rate or something. Anything is possible. But now they'll slap a drag racing charge on anyone they can, it seems.
I don't know anyone who's been through your EXACT situation, but I had a friend I worked with a couple years ago who wrecked his LS Integra at midnight while drunk - the dumbass - and the cops, who did not witness the accident or his driving, charged him with engaging in a speed contest because they saw two sets of skid marks - they thought he was racing someone who was in the oncoming lane, the phantom racer swerved, forcing my coworked off the road, etc. etc. etc....
It was all BS, but turned out to be hard to fight. They impounded his car (which was ALL messed up), and gave him the court date... and though he had a witness, it was his word against the testimony of the police officers...both of whom showed up. The prosecutor must prove the case, not the cops, btw... but you can guess who the judge usually sides with.
In my friend's case, he hired a lawyer, and did what oc_civic suggested - said he would plead guilty of speeding, but not racing because there was none. The judge yelled at him for a while (there was a passenger), and then actually yelled at the cops for trying to stick some bogus charge. In the end he had a ~$300 ticket, and a few points of his license. But because of that ruling, his insurance wouldn't cover the repairs...!!!
Just my $.02... but good luck, I really really hope you win. Maybe they'll even make the state pay for your legal fees!

This is not a traffic issue anymore, it is a criminal issue. The lady at the traffic window sent me to the criminal department. I'm sure in a criminal case, ah, whatever...
I'm going to go look for a lawyer this weekend, I'm going to see what kind of a deal the judge will give me on the arraignment date and judge my chances from there.

It's hard keeping a straight head thinking about this. I better bust out the 10 speed because if this doesn't get pleaded down I'm losing my license...
