Cops are outrageous... good lord... I'm positive that cop had some quota to meet; maybe he's trying to make detective, needs to up his arrest rate or something. Anything is possible. But now they'll slap a drag racing charge on anyone they can, it seems.

I don't know anyone who's been through your EXACT situation, but I had a friend I worked with a couple years ago who wrecked his LS Integra at midnight while drunk - the dumbass - and the cops, who did not witness the accident or his driving, charged him with engaging in a speed contest because they saw two sets of skid marks - they thought he was racing someone who was in the oncoming lane, the phantom racer swerved, forcing my coworked off the road, etc. etc. etc....

It was all BS, but turned out to be hard to fight. They impounded his car (which was ALL messed up), and gave him the court date... and though he had a witness, it was his word against the testimony of the police officers...both of whom showed up. The prosecutor must prove the case, not the cops, btw... but you can guess who the judge usually sides with.

In my friend's case, he hired a lawyer, and did what oc_civic suggested - said he would plead guilty of speeding, but not racing because there was none. The judge yelled at him for a while (there was a passenger), and then actually yelled at the cops for trying to stick some bogus charge. In the end he had a ~$300 ticket, and a few points of his license. But because of that ruling, his insurance wouldn't cover the repairs...!!!

Just my $.02... but good luck, I really really hope you win. Maybe they'll even make the state pay for your legal fees!
