Well, if you fix everything I've mentioned and it still does it then it's safe to say that they are. The seals are what hold the oil back from seeping into the intake and exhaust housings. You have oil in your downpipe so they are leaking now for sure. Unless... did you check to see if there's oil in the exhaust manifold pre-turbo?

the turbo is new. and there is no oil in the manifold.
