Backing up on the road way is illegal. Since he is going on the technically driving against traffic going the opposite way.

Also he didn't have insurance at the time of the accident so that is illegal too and his current insurance shouldn't cover any of the damages.

Your friend should offer to pay for the ladies damages, and you can have her sign something agreeing she won't sue in the future for any medical or unexpected car repair.

sounds to me it's 100% his fault, and he should pay out of his pocket. his current insurance has nothing to do with that incident. even if it wasn't completely his fault, he wasn't insured, so he has nothing to stand on anyway.

he's gotten into 2 similar accidents like this? how often does he go in reverse in the middle of the road? not trying to offend, but did he pull a rice-reverse? the one where you reverse all fast, unsafely, and stupidly?

no the quote in the dotted line is not my friend's quote.. it's a quote from another guy on a different website replying to the same topic.

Thanks for the replies.. I will tell him what you guys said. but if anybody else knows more about this situation please post here..

2 VERY easy questions....

#1 it's his fault
#2 he doesn't have insurance so he's screwed.

End of story, short, simple.

well, we all know he's not in the best situation.. but what would be the best option for him? just wait to get sued?
