some dude is driving down the street. As he passes in front of a maket he has an epiliptic shock. His foot slams the accelerator making him speed down the market killing 10 people. Should he be punished, jailled, ect... or not?

I say no. Unless he had seizures previously and wasn't supposed to be driving. Not his fault he had an unknown medical condition.
Still I don't know how I would feel as a family member of a victim

Should not be driving with the condition. Period.

Although I would give him something if he really had no clue he had it.

But I don't think this is something that comes up all of the sudden.

Depends on whether or not the condition was previously known....or this was just a freak occurrance.

He should have his license taken from him, but that's the extent of it. His insurance can pay off the victim's families.

I used to work with an epileptic who never had any problems with seizures, but one day had a blackout while driving and drove off the road into a river and nearly killed himself.

:werd: if he knew he had it he should not have been driving if he knew and still was driving then yes let him fry.

if he didnt know, and it was first seizure then not his fault.

if he did know - yes its his fault

Voted no. Actually seen similar happen at an event I worked back in 1996.


Sucks. The old guy felt so bad. Slammed into a booth of 5 people. Hurt 3. Killed one. It's horrible, but not his fault.
