Just get a lawyer, they'll get everything you need and make sure you don't lose out. Their payout is your payout too, so the more money they get for you the more you get. Insurance companies try to settle for as little as possible so they aren't looking in your best interest.
Lawyer up and get him/her to send you to a chiropractor. This is an open and shut case in your favor before it even began so start raping his insurance for money already.
The first time I got into an accident I got a lawyer immediately and the other insurance practically bent over and took it. They wanted to total my car for $9000 (a '98 Civic sedan) but the amount of damage was no where near that and I got it fixed for $3000 including labor. I also got PIP (personal injury protection) money that paid for my chiropractor, other medical expenses, and lost wages (pad this number) and finally the settlement money which was $4800 after my lawyer took out his share.

The only shitty thing during all of this was going to the chiropractor for roughly 4 months. With some luck you'll probably have some eye candy to look at because I always did.
P.S. I'm not sure if VA has PIP but if it does it's easy to pad numbers. The PIP paid me two months of lost wages which ended up being around $3600.
Don't feel guilty for all of this -- imagine what you can get with the money instead.

Like others said, lawyers will fight tooth and nail for your money because they take a percentage of the settlement. Most lawyers will take 33% but you might find a few that do 25% or even 20%.
