you actually have to accept the upgrade so that not really a problem. As for the MP3 there is a way... This whole trying to stop people from unlocking of installin 3rd party software thing only affect idiot who upgrades there Itune and Iphone firmware every week
It took me 45 min to unlock mine and cost me $0 i think that for $400 this phone is way worth it... i dont htink i would be able to find a better phone for that price really.

alittle reaserch show that if you have itune 7.4 no hack is needed. Just convert in ACC then change extention to .m4r and dump it in you ring tone folder in itunes and your set.

my qualms and reasons not to purchase:
no 3G - if im going to upgrade my phone and spend 400 doing it ... i better get 3G
no stereo bluetooth - so i buy a mp3 player/phone and i cant use stereo bluetooth headsets? booo
no manual managing of the music, its all auto sync
non-user replaceable battery
if a v2 comes out resolving some of or all of these issues then damn thats gonna be a nice product

you can manage it
just use itunesAgreed althought really not that much of a issue i mean honestly i never just change the battery in my phone.
It will be more expensive and will take a shit load more work to unlock it.
Oh also to everyone out there that wa interested to get 1 and unlock it you better jump on them now cause if they come preinstalled with V1.11 you will have a hard to unlock them.

as for the itunes, you cant just drag and drop like with a ipod. its all done through a auto sync feature.
and to batteries, i sometimes go places where i have good coverage but no access to electricity or its difficult to get to, and i like to carry an extra battery to last me the week or weekend.
