Any car insurance people here? question.

Well Saturday we took our daughter to go see Curious George. Good movie. Anyway we got into our van and my wife started backing out.
She had to quickly stop because someone decided to drive by really quick. As soon as the person went by my wife continued to back up. All of a sudden *CRUNCH* we hit someone.
Apparently that car that drove by decided to stop and back up into the spot that was next to us AS we were backing out. So we both ran into each other. I hate people that back INTO spots.
My wife and the driver were the 1st out of the car. The lady started screaming and bitching at my wife. So I got out of the car and tell the lady to stop screaming and chill out. She was with another person and a little girl (around 10 years old).
We take the lady's info down only to find out it's her sister inlaw's car and she (the driver) is from Florida.
So who's at fault? I kind of at 1st thought it was our fault then thought about it and maybe could be both our faults since we were both backing up.
It was a 2000 Honda Civic Ex (4-door) and we cracked her bumped on the passenger's side and of course scuffed her bumper. Our bumper is a little scuffed. The estimate for her car was around $350.

hhmm...sounds to me like it would end up being no fault.............BUT if the other lady was backing into the spot she should have had a MUCH better view of the situation and could have prevented it i think........to me it sounds like it will either be on her or no fault...
its up to your and her insurance' claims adjuster...
also, if her estimate is only $350, its not even worth reporting to the insurance company, if your insurance pays her out on the damage, the $350 you saved is nothing compared to the "at fault" accident that goes on your record for the next 3 yrs which will probably hike up your premium by a couple hundred bucks a year.
whatever you do, try to avoid your insurance company having to pay her (the other lady) on the damage.

Most insurance has a clause to cover any person driving the car.
if it is in a parking lot, then there is no fault automatically...its on private grounds, and no ticket will be issued. Though you should have called the police as they would have issued a dual police report for your insurance. Insurance will then call you and ask you what happened and determine if they themselves feel you or the other person was at faul and either waive or apply your deductible.

I had a similar thing happen to me from the other perspective. Basically, this lady backed into my car while backing out of a spot. The parking lot no fault thing only applies if your state is a no fault insurance state, otherwise, the insurance companies will duke it out to figure out who's at fault even though no ticket was issued. Colorado had just changed to a fault insurance state. Her insurance company ended up paying the my deductible because she was going from a stopped position (the parking spot) entering a traffic flow pattern (the aisle), so it was her responsibility to be careful. She was also really nice about it, and admitted backing into my car. So, you might end up being at fault depending on how insurance is structured in your state.
