So I bought another car from private party. The woman didn't have pink slip because car wasn't payed off but she said she sent in the payment already and will fedex it to me when she gets it. I went to DMV and I can't register the car bc I don't have pink slip. Is the car mine technically since I already paid her for it? I have bill of sales but thats it. No other paperwork from it. I am just thinking I should return it but I don't know if she will just say, "you already bought it".

 

technically as far as DMV is concerned, the car is still hers. you need to get the pinkslip from her and she also needs to sign a release of liability and send that in to dmv. and if the bank hasnt received the last payments yet, the bank is also technically still the lienholder of the vehicle.

 

I think she already sent release of liability form. I am just thinking I should return it cause I haven't driven it since I got it and that will be 2 weeks on monday.

 

oh, and i forgot... if the bank hasnt received the remaining payments, then the bank still holds the pinkslip, not her. therefore, she has no way of giving you the pinkslip until the bank releases it to her first.

she can "sell" the car without possession of the pinkslip... but then you'll have no way of registering the car without it.

 

she cant legally sell something she doesnt own, so no, you have to have a pink slip
