I fully agree. If I want a break i need to go outside with the smokers. No other reason to go take a break.

yea i think thats really stupid. firing people because they smoke at work. i dont smoke, i dont want to, but the fact that you can fire someone for that is just retarded.

If they actually fired someone because they are a smoker they would get sued and lose in wrongful termination suit. It is the whole state, not just SF that banned smoking. I don't smoke, but think this is an undue infringement on civil liberties. Where the hell is the ACLU on this one? If a business is family owned and operated, they can allow smoking. It is amazing how packed the places are that allow it. I remember when SF banned it in bars, i thought it was ridiculous then, and still do. Yeah, this state is pretty messed up in a lot of ways.

Even as a non-smoker, I object to this rediculous measure. The SF board of supervisors as always been a haven for nutjobs...but even taking that into account, this is a virtually unenforceable code that will only hurt SF's tourism buisness.

That said.. I have to clear things up here:

First off, this is not a state-wide ban, and it's not even in effect yet.
It's a municipal code to be enacted - assuming SF Mayor Newsom signs it - on July 1st.

Second, there is no mention of this municipal code having an effect on laws outside the City and County of San Francisco.

Third, there is no mention of smoking becoming a lawful basis for firing any employee.

I had a boss that wouldn't hire people who smoked. He hired me before he asked me if i did, and the other girl there told me to hide it. When I was looking for my replacement, he told me to ask them if they smoked. I told him I wasn't comfortable with that.

Then on my last day, I made a point of him seeing me smoke. Considering I was a pretty damn good worker, maybe now he won't be so anal. I doubt it though, considering he rejected a black girl that was ten more times qualified than me.
