OK, well, here's some advice for you, then: Stop using marijuana and stop driving under the influence.

Most jurisdictions have two charges, DUI and DWI. DUI means you are over the limit, and DWI is a more serious charge that means you were over a second, higher limit.

It's funny, but after you've been doing this for a while, you can tell which substance somebody's on by watching how he's driving.

It most certainly is not "apparent."

It is "evident" if the culprit testifies to that, but it's still not "apparent."

That sucks man. My GF got a DUI a couple weeks ago, but she hasn't went to court yet so I can't really offer any suggestions. I wish everyone who hasn't tried marijuana would quit acting like it's so f-ing bad. It does not make you more dangerous than anyone sober. If anything it makes you drive safer. Don't believe me, then TRY it! Alcohol is a different story. Did you admit to smoking? THC can be in your blood for 30 days (as I'm sure you know). So unless he smelled it, or you admitted it there is no way they can prove you were under the influence.

In Milwaukee, probably the whole state of WI, a small bit of Marijuana is just a ticket. If its an ounce or more however, its an intent to sell, which leads to a felony charge.

Yeah everything up to 36 grams is a misdemeanor in Montana too

You can't prove that you didn't crush the pills. So it's the officer's word against the one that's arrested.

As for the DWI charges:
  • Driving while ability impaired by alcohol (DWAI): 90-day suspension.
  • Driving while ability impaired by drugs (DWAI-drug): minimum six-month revocation.
  • Driving while intoxicated (DWI), with .08 of one percent blood alcohol content (.08 BAC): minimum six-month revocation.
  • Driving under the influence of alcohol or drugs out-of-state (DUI): minimum 90-day revocation.
  • DWAI violation within five years of any prior alcohol or drug-related violation: minimum six-month revocation.
  • DWI, .08 BAC, or DWAI-drug violation committed within ten years of any prior DWI, .08 BAC, or DWAI-drug violation: minimum one-year revocation.

    Regardless, you shouldn't have been on the road...
