thats the same way it is here in nebraska plus they have some stupid 50/50 law where they could call it for example 60% his 40% yours or visa versa. i got hosed by that law before. the insurance company made the persentage of fault just enough so that i had to pay for my vehicle and they had to pay for theirs. all because the police report said according to my skid marks i was going 41mph i was in a 40mph zone

Always, always, ALWAYS call it in the the Police. If there's not enough damage to warrent a report, at the least they'll do is an "Exchange of Information." You get the other guys stuff, the other guy get's yours, and the cop get's both. That way you have SOMETHING to go on rather than nothing.

I hope you have a witness and/or ploice report for this accident, if not the insurance company will try to screw you outa money thats rightfully yours.

Its definitly his fault, that is...if its documented that he made a moving violation which resulted in the crash, therefor he/she is liable for the damage.

also, you stated you didn't think there's enough damage to call the police and file a report.....any damage, that is visible, even a scratch must be accounted for, and I assume from reading this that, you have some damage. Even a minor dent will cost over a $100 to remove.
I had some idiot back into my other teg, and it left a dent on the rear panel between the tail lites, it was very minor, anyway I took it to the best shop in town, they charged the ins company over $400.00

so like i said, i hope you DID get a police report.

Well it wasn't a four way stop, we were inside a parking structure, and I had the stop sign. We both reached the intersection at the same time. And both stopped because thats how crappy the layout of the structure is. He waved me through, so i assumed it was safe to proceed, but he's foolish enough to move before i even clear the intersection. Now that i think about it he might have been making a left as well considering the angle of his car.

So he didn't have a stop sign, did he?

I would try to work the angle that you were already in the intersection and he failed to yield the right of way. Who waved on who may be irrelevant.

Ya...I think unless he admits its his fault I might get screwed. I discussed it over with a liability adjuster and all she told me was that she had to discuss it over with her supervisor.
