my first speeding ticket! ever
now i know how some of you feel when you get pull over and get a ticket for something you absolutely did not do. please read. i post this here since i drive a accord and maybe some of you with non stock wheel can answer some of my question.
so i am driving on a 4lane tunnel which is about 3 blocks long, I enter the tunnel and there is lots of traffic righ behind me in my tail and have cars next to me and a van in front of me in right lane. now the lane that the van is becomes one lane. the van is in front next to me so i slow down so i can get behind the van but he slow down wayy more than I so i just continue driving and get in front of him. when i exit the tunnel i am the first car in front and the entire tunnel full of cars behind me all lane become 1 lane on the left where i was. next thing i know i see this person about 20-30 yards away from me in the side of the street and walking towards the middle so i just keep driving and slow down since there is a traffic light a few feet behind him so i was driving at 30mph and the max i did was 35mph in the tunnel. the person i see walking to the middle is a cop which i didnt know since it was still dark at 7am. he walk to the middle of the street and signal me to stop so i pull over completely and carefull since i have traffic in my tail "if u drive in nyc u should know what i am talking about" and hold alllll the traffic then he direct me to the side of the street. he ask me for license and registration and i ask why he just repeated himself and didnt answer me, so i just give him the license and reg. he walk to his car (detective car) which is park on top of the bridge heh i waited and he comes back with my stuff and a little yellow paper roll like ten times so i dont even know what it is and he tells me i was speeding at 49mph and have a nice day. i immediately ask him to show me the proof that i was going at that speed and i can see a radar gun n his hand but he walk away and ignore me. i been looking at the ticket while driving home and i notice he also wrote down uninspec vehicle? but it expire the 14th and today is the 13th and i am going to get that done today and he wrote i was driving at 49mph and speed limit is 30mph and it says unposted speed? dont know what it mean exactly but i guess there were no signs saying the speed limit around, am i right?
some of you might think i was giong at 49mph but i can not be wrong because i was looking at my dash the entire time because i been driving with the gas light on E for few miles and i been driving slow and making sure i dont step on the gas too much so i wont waste gas.
i notice n the ticket it say if i drive over 11-30mph over the limit the fine is $95 and 1-10mph is $45. there is no way in hell i drove no more than 5mph limit.
here is my question for you guys. i currently have 17 45 215 tired i am sure i am either under or over 5mph. which one is? but still i will be driving under 49mph. i am going to plead not guilty and this smart cop didnt even give me a envelope just a plain small yellow paper, incredible.
how many of you think i should fight this and i will win? #1 he never told me why he pull me over or why he ask me for id and reg. #2 he declined to show me proof even though i saw the speed gun he had n his hand. #3 every car was going at my speed behind me and even faster. the van next to me which i know realize the van driver most have seen the cop n the middle of the street since the van is higher. #4 there was no speed limit posted #5 how can he posibly know the speed i am driving when he is standing in the middle of the street and there is no way he can get me from the side since i am on a tunnel next to the wall and from what i understand a radar gets the speed when the car pass by you righ? i never got to pass the cop he was already waiting on the middle of the street before i even saw him. and last this cop most be blind my inspection is not expire if that is what it mean.
it is logical that this cop knew he was doing everything wrong especially with the small paper fold heh and think i am going to pay this fine and not plead guilty since this happen in manhattan around the united nations which only rich ppl live around here and would rather pay a fine instead of going to court. how come he didnt ask for insurance card? i just realize that righ now. from my understanding if u speed or take red lightthey ask for insurance or not?

Most i usually see is a 2 mph difference but that is at 60mph..

Id fight it specially since you asked for proof and he was being a dick about it. Same thing happened to my friend. A cop driving in the opposite direction pulled him over and told him he was speeding in a snow squall. But when he pulled us over it had just started snowing. Then when he asked for proof the cop was a dick about everything. So he went to court and fought it and won.

Kinda odd that he spotted you traveling at 49mph when your slowing down to a red light.
If he estimates your speed at 49mph thats a pretty good assumption, unless he had his radar gun..........

I get stopped for crossing the street carrying my PC in one arm and eating an ice cream in the other hand. And the cop dares and asks me where am I going with that.......... ( Its great to have a family member up in the ranks in the D.E.A because without him I'd owe so much money on B.S tickets ).
How can the public police the police?
I mean can they just walk up to you and hand you a ticket even though your registration expires tomorrow or give you a speeding ticket with no proof.
I wish the police officers in NY could show professionalism and be courteous like Miami Cops.....No cop up here has ever told me to have a nice day...lol.

yeah the police sign the ticket and you can not get out of the tunnel wrong because the white solid lanes disapear when u are about to exit the tunnel and the righ lanes merge with you. so you just have to becareful someone else dont hit you or is on a blind spot. is funny because is the first time i drive in that tunnel so slow and careful all becuase i didnt have gas left . hey u romeo u most know where this is. you know the tunnel on 1st avenue around 47street 45th also there is a trump tower there. already send the ticket not guilty and i am going to drive by the same place in a few hrs. i actually drive in that tunnel everyday.

Fight it. Your mph is short not long so under is the answer on that. The cop didn't state his probable cause to you and that is an infraction of civil code. "The reason why I pulled you over"...yada yada... you know what I mean. Also, on radar it does not detect what passes through it. It sends a signal to your car bounces off and returns to the radar. The amount of time it takes for that to happens determines how fast you are going. Good luck!!!
Fight it! I got a ticket last year for going 70+ in a 60 zone. Well, I did lots of research, and contacted my states department of transportation. They wrote me an official letter with the speed limits, and what mile posts they change at. Turns out, I was in a 70 zone!!!! And to top it all off, when I got pulled over, I asked the officer, "What is the speed limit here?" He replied back, "60 miles an hour, did you see the signs back there with the orange flags on top?"
I was going from Seattle to Canada, and the speed limit goes from 60 to 70, to 60, to 70, to 60, and back up to 70. Very confusing for my first time driving up. Went to court, with tons of proof and documentation of everything. Won my case, and now working on winning back the money I spent on research from state of WA. I have reciepts and lots of proof.
Anyway, fight it! Hire a lawyer if you feel like you need one. Get a copy of your driving record to show you are a good driver.

I think the police department that issued the ticket should be required to cover your court fees if the ticket is thrown out. I bet the largest donations to policeman charities comes from defense lawyers. Cops should be held accountable for writing bad tickets.
Good luck in fighting this ticket. Speeding tickets are difficult to fight but with a lot of research and effort they can be fought and won. Typically when you get a ticket if you go to court and have a clean driving record the prosecutor will usually offer you a reduced charge in exchange for pleading guilty (to the reduced charge). This is done for the benefit of the court and the individual. The court clears the case and the individual typically gets off with a lessor charge and fee. My son recently got a ticket for going through a red light. He had a clean record so he went to court, was respectful to the prosecutor and judge, and got off with a parking ticket (not a moving violation with points). Unfortunately, in NYC they do not offer any special deals so you need to prove/demonstrate your innocence to beat this ticket.
My recommendations;
1) Cool down. No one thinks that they deserve a ticket and in some cases they don't but in most they do. The judge hears it all day long and if you are angry or disrespectfully he is likely not to believe your argument.
2) Get the facts. If the officer clocked you with a radar gun it wasn't when he walked into the street it was before. He had to follow correct procedure and the gun needed to be recently calibrated and inspected. I am not 100% familiar with what the laws are but they are documented on the web, look for them. On your trial date you may ask the officer to produce this documentation. Unfortunately, since he will be going to court you can bet your bottom dollar that all of his paperwork and testimony in this area will be well prepared and presented.
3) Get the officers documentation on the traffic stop. You are entitled to see the evidence before the trial. The officer will have written down all of his facts and your are entitled to see it before hand. There are laws pertaining to the number of days you have to ask for this so once again research the web for the answers. Again, all of this will all probably be in good form.
4) Be prepared. Your defense of the officer didn't tell me why I was stopped, the officer is a dick, I was running out of gas, I couldn't have been speeding, I never speed, etc., etc., etc., is not evidence. Knowing the law and the circumstances of the stop are probably going to be the areas to focus on. If all was done correctly you probably will have little or no chance of winning and may even walk out of court with a larger fine so be prepared for the trial.
Though you probably will lose (most people do in NYC) it is worth fighting. Sometimes you are lucky and the officer cannot be there. I believe that the court is allowed one postponement and after that the charges are dismissed. In terms of your inspection you will need to bring proof that the inspection sticker was not expired. Make sure that you bring proof, perhaps a written receipt from the inspection station stating your old inspection date.
