That's what I meant, basically. Since people have to sign releases to let companies and whatnot use their stuff, shouldn't this guy have the same rights? Maybe I should copyright my car. My uncle can do it for me for freeeeeee

Its hard to say. Copyrights is how the print/media industry protect their images. Im a graphic designer and I would never dare to use anyone's copyright images from stock photography or photo files without paying the royalty. Major lawsuits will be filed if they catch you making money off their copyrighted images.


But for uncopyrighted images, its hard to argue. Yes you can file a complaint and try to sue, but I doubt "according" to laws that you will get much money from it. You should look at logos and trademarks, they are basically taking each other's designs, and just tweaking it here and there.

If its your picture, it's copyrighted. They may have gotten it off a public website, but this does not mean the image is public domain.

You definetly have a case here. As soon as they know it's serious, they'll either just take it off, or try to settle.

Every image not expressly copywritten that is put on the internet IS public domain.

Internet law is the nastiest, most poorly defined set of laws you will ever see in your entire life. Even worse than international law, which is, quite frankly, amazing.

What was stated is all true, very tough situation... one hand, your picture isn't copywritten (no fine print in pics... hey which reminds me.....) but on the other hand, it is YOUR intellectual property... I'd assume you won't get much out of it, other than them simply taking your pic down.

bull crap. you can get some sort of settlement from that. they just got some cac to pull a car off the internet and he got yours. you found it so its time to get paid.

hurry up and sue. I think you could easily get the value of the car.
