Alright, after consulting with a few of my professors (all lawyers, though mostly in international law), they said that your friend has maybe one toe to stand on. Unless the image was copywritten BEFORE it was placed on the internet, you're pretty much toast.
He might want to think about asking Pepsi for simply a mention or the like.
Make sure not to say or do anything offensive, Pepsi is horrible about countersuits.

what q-tiger said is true. unless your pix is copyrighted before they stole it, you dont have a chance for a lawsuit.

Wouldn't he have had to sign some sort of release form allowing them to post a picture of his car on their website? I mean, Jackass had to get all these random people to sign release forms before they could show the people's faces on TV. Aren't TV and internet both forms of mass communication, making people's private property protected under the same laws?
