Because of this the placing of the flags by family members is acceptable and would then have resulted in him being found in violation of the desecration of a grave. Since the confederate flags were placed there by an organization and not by the family this law does not cinto play.
We discussed the aspects of dying under the flag and the right to fly it in that context which he agreed with, but since the organization took it upon themselves to place those flags there it was the equivelant of littering and he removed them.
Can't say I agree with him 100% but I do see his reasoning a bit clearer. The photo op was definitely a poor choice and even he admitted that.
Isn't it only littering if the property owner doesn't want it there? If someone puts a campaign sign in my yard it's because I want it there. I didn't put it there though but that doesn't mean any Joe off the street can come and remove it from my property just because I personally didn't put it there.
It's up to the "property owner" or their family to determine if it remains or not.
