you may know what your talking about when it comes to brake checks BUT

brake checking and illegally passing someone and then purposely coming to a complete stop for no reason in the middle of the road directly in front of them are two completely different things. no way in hell the way that a judge would call what he did as brake checking if he described that story exactly.

the only reason that he got off like he has so far is the simple fact the other guy wound up blowing. if the guy hadnt been intoxicated, the whole scenario would be playing out quite differently, and you may still see it happen where he gets in a bit of trouble for what he did.
