Legally, it's arguable in court he isn't. It's like junk mail that sends you something (like address labels) and says you need to pay them to keep it, or send it back at your own cost. Legally, because you didn't ask for the service or product, those labels are yours. If he broke of the transaction, and the vendor sent it anyway, then the lip could be considered an unsolicited product, so it is his to keep.
