Actually, it's not. Before vibration controllers came out, this was a "novel" idea; aka pententable. It's obvious now, but wasn't before.
Anyways, Sony will find a way to settle. Don't worry, PS2 will not stop shipping to US. They'll find a way.
Microsoft is probably going to get sued next.
