He is the adult in this matter and is held responsible because without a doubt he knows better. This is how the courts will see it regardless of the excuse 9 times out of 10.
He made a move in deciding to "make out" with her. He could have instead simply excused himself from the situation. To add to that he was the one who initiated contact by "tickling" her, which is construed as a move to gain contact whether sensual or not.
