Well if they have smog devices, the cars still need them and they need to function. Just because the car doesn't need to be smogged doesn't mean they can have their devices removed.

Also there is a new law that has already been passed, 1974 and older cars are smogged exempt, no more 30 years and older cars smog exempt.
