A federal appeals court has revived a lawsuit that could put the squeeze on fast-food giant McDonald's for obesity claims by some of its customers.

The appellate panel in New York on Tuesday reversed a lower court decision that dismissed the suit claiming McDonald's used deceptive advertising to trick consumers into eating unhealthy food.

The suit is on behalf of two New York teen-agers who said they ate at McDonald's three to five times a week for years, and blame the company for obesity, diabetes, coronary disease, high blood pressure, high cholesterol and other ailments.

Tuesday's decision overturned a September 2003 lower court ruling that tossed out the case. The appeals panel found that the allegation that McDonald's violated the New York Consumer Protection Act was worthy of "inspection" by the court.

The suit alleges McDonald's failed to provide customers with free, written, easily understood nutritional information about its fast food and neglected to "adequately disclose that its use of certain additives and the manner of its food processing rendered certain of its foods substantially less healthy than represented."

McDonald's said in a statement it was confident the case would ultimately fail.

"Common sense tells you this particular case makes no sense," the statement said, adding, "Today's ruling, which is strictly procedural, simply delays the inevitable conclusion that this case is without merit."
