okay this what happen to my gf

her story...
she was on the right side with her del sol
the guy was on the left side with a full size uhaul

she saw the guy front signal then he start moving over to her lane. She start breaking and went into the shoulder to try to avoid the uhaul. The uhual went all the way into the shoulder because there is a right turning lane coming up.


they guy story(from what the guy start bitching about when he get out of the uhual to my gf and from what he told the cop)
he was on the right lane he saw my gf in the back...he signal to get into the right turning lane and my gf switch over to the shoulder to speed past him.

to me i think my gf told the true story because, there no way a del sol si speed up that quickly and the damage on her car was mainly on the front driver fender and little scratch all the way to the rear. There no real damage to the uhaul, but i notice there is tire rub and paint chip from the del sol starting right behind the uhaul door.

cops came took his story and my gf story down and gave each a report to fill out and submit to the state.

SO insurance wise who fault is it? would it be a no body fault because no witness was there??? any imput from a insurance person would be helpful

 

hes mostly in the wrong i think.

 

i hope so, i hate to see our insurance raised and hate to pay deductable...im current saving up for my car too. this suck

 

it's hard to say. i don't know who's being honest. when exactly did they make contact? and why didn't she brake harder? or did she?

 

from what i understand, shortly before the shoulder turn into a right turning lane and they hit when she was in the shoulder. on the passanger side of her car you could see the tire rub against the curb too

 

did they guy say anything at all about changing lanes?? i bet that if he did, it would be considered his fault. i bet he didnt see her in his blind spot when he was changing lanes. blind spots on a u-haul are a bish. generally speaking, people driving uhauls have abosoutely NO IDEA how to drive them.

 

If the girl got hit while her car was on the shoulder, it's the U-Haul driver's fault. He admitted that he intended to make a right turn, and he admitted seeing the car. So he had no excuse for going off the road. He struck a car that he admits seeing. In some states he could be charged with felony assault with a deadly weapon for that.

If she hasn't done so already, tell your g/f not to tell her insurance company about the collision. She can make a claim with the U-Haul driver's insurance company. It doesn't sound like a lot of damage, so if worse comes to worse, she can fix it out-of-pocket. But if she lets her insurance company handle it, they might get lazy and never collect from the U-Haul driver's insurance company. In that case it shows up on CLUE as her fault regardless of who is really at fault.

 

what suck is that guy didnt have his insurance with him, the cop did tell him that he need to call the cop with the policy number right away...

i'm pretty much a noob to this, so me and my gf kinda clueless. should we just fill out the report to sent to the state and wait for his insurance to contact us?

 

Pictures and witnesses, because they will count for a lot more in a court of law.

 

no other car stoped, so witness..
could take picture of the del sol and where it happen but thats pretty much it the guy who drive the Uhaul is moving his ass to another state also.

i guess the real question is who determain whos fault it is??? does the state do that? and how the insurance would know??

i guess i might just contact our insurance and see what they say. either way it need to be fix because she getting into her car throu the window or the passanger side.
