The Fair Housing Act (Title VIII of the Civil Rights Act of 1968) introduced meaningful federal enforcement mechanisms. It outlawed:
  • Refusal to sell or rent a dwelling to any person because of race, color, religion or national origin.
  • Discrimination based on race, color, religion or national origin in the terms, conditions or privilege of the sale or rental of a dwelling.
  • Advertising the sale or rental of a dwelling indicating preference of discrimination based on race, color, religion or national origin.
  • Coercing, threatening, intimidating, or interfering with a person's enjoyment or exercise of housing rights based on discriminatory reasons or retaliating against a person or organization that aids or encourages the exercise or enjoyment of fair housing rights.

I think its different if you're looking for someone to reside in the residence WITH you, so maybe thats the tricky part.

That might be different, looking for a roommate vs. renting out

oh no you're completely right about the race color and religion part

i was speaking specifically about the gender / age aspect. i think its quite legal for someone to refuse to rent to someone because they are say 18 or 85. or a woman who doesnt want to rent to 4 19 year old guys.

but i'm not positive

Ah, gotcha.

"As of 2007, no federal protection against discrimination based on sexual orientation or gender identity is provided, but these protections do exist in some localities."

I would also think that sending pictures would be allowed in a situation like this (obviously assuming this was legit and not a nigerian scam), because that way when the "pastor" gets back to the states he would know what his tenants looked like, in case he needed to make a house call to fix things or whatnot. As long as he's not basing the rental decision on the pictures.

Somebody has been taking my active (for sale) listings and copying all the pictures and descriptions from my internet marketing and making phony craigslist rental ads out of them.

If you respond to the ad, you get almost the exact same bullshit scammer response. Fuck these guys.
