because that allows you to walk away from a running pump. an unattended, running pump is what is illegal in some states, not the gas cap in the handle, as far as i know.

Well, at the Hess up the street, they all stop automatically but there is a big sticker next to the nozzle that says "Illegal to put cap in handle".
