Default I suck...

So I just got pulled over in the MS3. He claimed I was doing 80 in a 40. I don't know what the fuck to do. I have never been pulled over in 8 years, let alone for something like this.

Is my license in jeopardy? I don't know if I should fight it, let it ride, or what.

I need some help. Cop didn't even get a radar reading.

was it strictly a speeding ticket? some of the higher speeds go to a reckless driving charge. but if it's strictly a speeding ticket your license is fine it should be 6 points at most which is half the limit here. Take a DD course and get it down to 2 points.

According to the CA dmv site it is 1 point.

He said "I had to do 110 to catch up to you"

oh and if you go to court, they only have to prove that you were speeding for the ticket to hold, not that you were going the speed on the ticket. So fighting it will mostly likely be pointless unless he really didn't have any idea of the speed.

Take it to court or, if it works in your area, write a letter to the DA asking to have it pleaded down to non-moving violation. You might try with court if you want to gamble since you have a clean record and the cop wasn't running radar but, at least in my area, a letter of request to plead down is a sure thing as I've done it successfully at least 5 times.

FWIW, anything over 30 or more over the limit will jeopardize your license.

How fast were you really going?

He had no idea of the speed since he didn't catch me on radar and "had to do 110 to catch up"

I disagree. There are drastic differences between 5mph over and 40mph over. By what you said, any cop could write you a ticket for 40 over even if he can only prove you were going 5 over.

You should have asked him if he was going to ticket himself.
