benz's, no matter their age, r not cheap to repair. id say split the cost since he asked/gave u permission to drive the car. your accident is a minor single car accident. u and the owner would be responsible for any damages to the property and injuries to anyone in the car. liability wise u r more at fault since u were driving. had u hit another car and caused damage and injuries u would be more responsible then the owner. all of the occupants used poor judgement getting into that car. that is why there are cabs and others u can opt to call if u r drunk.

As an answer to your first question....

40 km/h is about 25 mph. But, a lot of what happens depends on the curb's height and shape. I had a friend a couple of years ago who bent the LCA on his Del Sol doing pretty much what you did. Benz isn't a Del Sol, I know, but given a big enough curb and square enough smacking angle it is possible. Best case is if it's a low or slanted curb and you took it head on, so the wheel just hopped over it.

Im just gonna take it to the shop with him, and depending on the cost...then make a full offer or talk to him about maybe splitting. I know this sounds cheap but I think many would choose this route. Friends before money always though, whenver a situation involving money arrises I really do think its better for both to give in a bit more rather than both be blaming.
