Check this out, who in their right mind would do business with these clowns? Even if they were the only possible source for something, I would do without.

I just glanced over it... but it seems pretty standard. Howver suck ass it may be... it doesn't see out of the ordinary.

Late last year, Philip Morris USA, Inc sent out MasterCard Debit Cards (pre-loaded with $10) in promotion of some anniversary that the company is having. By sending in 125 Marlboro Miles an additional $25 would be added to the balance on the card. why are they doing this? The answer can be found in the last paragraph of the fine print of the Rewards Program Rules:
By use of this card, you agree that any and all disputes of any kind between you and the Rewards Program Provider (Philip Morris USA, Inc) and its directors, officers, employees assigns and affiliates will be resolved either through arbitration…or in a small claims tribunal in your state. By accepting these terms, you specifically waive the right to a jury trial; and you specifically waive the right to participate in any way in any class action, private attorney general action, or any collective action.

I got one of those debit cards in the mail, and I found 125 miles from littered empty packs. I don't smoke, but I got a free $35 :thumbup:

no that would be illegal. they are however limiting the amount of damages the person can claim. most small claims limit the max amount to $5K or less.

There are several clauses in there that do not fit with the law, I have never done business with a company that would force me to come to there state to sue them for example(that would belong in Federal court) there are actually a lot of things in there that would dissuade me from doing business with them.
Most terms and conditions like that are all a bunch of b.s. anyway. They are drafted to convince people that they can't bring a lawsuit, even though they can, or convince them to play by the company's rules instead of suing.
You can get rid of most of that crap anyway.
