That got me thinking.... as another thing that bothers us. (I can see both sides of the argument though)

If someone patents or copywrights something, and if someone else truely then comes up with something similar or the same, should be able to use it. Of course there that whole proving you didn't know about it part.

But really, if I'm in my garage and all of a sudden I come up with a great idea for something new or a new way to do it, I should be able to make and market it.
