so we have an existing accepted violation of seperation of church and state on the books in each state. are you suggesting we correct that with another violation of constitutional law?

Exactly, which is why I think states should not endorse marriage at all and only give out civil unions to couples that want to take benefit of their legal rights granted to them by the State and Federal governments.
