Sado masochism is different than rape.

People have rape fantasies and act them out but it is still consensual (sp?) sex even though it simulates forced sex.

If a person does not want sex and either is incapacitated to not be able to state it or it is forced upon them then it is rape regardless.

I wish I could remember the state the case was in but it was like 4 years ago I think.

Yeah, because that would be interesting to me... I think Cali's rape laws are fairly comprehensive, but I could definately see some distinction being drawn in some of the lower states to define rape as forceful/unwanted penetration

 

Yeah I think since that point most state laws have been changed to read as unwanted sexual contact rather than penetration because of things like this coming up.
