Sorry Jae but you are breaking the law by offering a modified BIOS.

Any modification of the Xbox or its OS is considered a breach of the "fair use agreement" and falls under the lines of reverse engineering. Because you are offering it with a different HDD then your intention is obviously to make it possible for a person to either rip or load DLd games to their box. This makes the box or boxes you are selling illegal as well as your claim to be selling premodded Xbox'.

you could terminate the auction and then just sell the xbox by itself, and then later sell the hd separately?

Im not offering the bios. I made sure i didnt say that. I changed it so that it shows the hard drive will not be installed but it will come with it. Meaning who ever does it they are liable for everything. Plus the bios i would offer is legal from what the website you get the bios from says. Its the Cromwell bios and from what i read its a legal bios. Im thinkin about closing it early since i already have enuff people who Emailed me about it.

O and Tink. It'll be 300 i'll waive the shipping fee for ya

I'd like to try and help clear up some of the legal issues here.

If you agree to any terms of use or service when you buy an XBox, thats a contract, and if you break those terms you might be held liable in a civil court, but that doesn't mean you did anything illegal. Microsoft may be a bunch of hard-assed mother****ers, but they can't write laws.

If there is anything criminal about modding an XBox, I think you would most likely find it in the Digital Millennium Copyright Act, which states that any technology that circumvents a copyright protection mechanism is illegal to create or sell. I'm not sure how mod chips work on the XBox, so I couldn't say for sure that the DMCA applies here.

What you are saying is true the DMCA does not come into play when you mod your XBX, however if you offer modding services to others, or you offer to sell an XBX which has been modded then it is illegal and the DMCA is very applicable in that instance. It is considered a modification of the hardware and a reverse engineering of the software for the XBX. When you purchase the XBX if you read the owners manual you will see it has the usual info regarding implied fair use and the warnings against reverse engineering.

Jae you say the BIOS you offer is legal...so MS has it available on its website and you get a written note from MS that this BIOS is an approved upgrade to the one already in place? You are also offering a chip to be put into the box, does this chip have MS' stamp of approval as well, and is there an implied useage agreement included as written by MS? If these products do not have an MS license they are reverse engineering by design no matter how you argue it.

Though technically not illegal for private use but by making them available and offering to install for a price makes your end of the deal illegal.

Personally I could care less but I am just letting you know that this is how the courts look at it and this is the stance ebay has to take on it as well so they don't get their asses sued for facilitating illegal activity.
