when the celica was messed up, the kid that did it was going to come talk to us all with his mom...Kevin was allowed to ask whatever he wanted. We were going to record him, without him knowing so he wouldnt be reluctant to say certain things, but we asked the Officer on the case and he said that we HAD to tell him that he was being recorded. I don't know if the law varies from state to state, but i know that's how it is in PA. It doesnt matter why you're recording them, they HAVE to know that it's being done.

and, wouldnt using it to defend himself, ultimately be using it against her? :thinking:

just a metaphor....like u trying to protect yourself from something and your action is ILLEGAL.

ex: u got a flu shot and your friends sue your butt off cuz they claim that you didn't tell them about it so they was 10 hours trying to give u a flu. u heard!!!

The law on recording varies state to state...in some states only one party has to know they are being recorded for it to be legal.

well, i think the difference is..

if you call me, tell me you're going to frame me for something, and then do it.. when i get accused of it, i think i can say, "listen to this recording, it wasn't me!"

but if you call me, tell me something compromising, i record it, and bring to someone and say, "listen to this! arrest her!" or whatever.. i think that's when it becomes inadmissible.

but then again, i'm no lawyer.
