Default my friend's night

He was driving between Louisville and Boulder at about 2am, and he got pulled over because the cop "couldn't see his temp tags." They were sitting right there where the stock plate goes, w/ the light on it and everything, so basically, they just pulled him over for the hell of it.

The cop looked at him (he had just gotten back from a 5-hour flight that morning) and saw that his eyes were bloodshot, so made him get out and do a roadside sobriety test. For some reason they don't do in-car breath-tests anymore. So anyway, he "fails" the roadside because hes an oaf, so they cuff him, tow his car, throw him in the back of the popo car and take him back to the station on suspicion of DUI. They throw him in the drunk tank and he has to wait around there almost an hour before they give him a breathalizer.

He blows a 0.002, which is like 1/20 the limit for DWAI, much less DUI. Basically that just means he used scope in the morning (he did actually have a beer like 5 hours prior). So they take him to get his car out of impound and its 5:00 in the morning by the time he's finally free.

Summary: the cops pulled him over for no reason, totally ****ed any chance of sleep, put him through a tremendous PITA, all for nothing. No, "sorry," no nothing. Boy was he pissed.

I'd be ripshit too. I'm not one to join the cop hater bandwagon, but shit like that pisses me off.

why dont cops give breathalizers right when they pull you over? can you jsut request one, os you odnt have to go through all that other shit?

The problem is that some cops have little better to do than pick on people. If this officer wanted to be a dick, even if his friend wanted and could have gotten a breathalizer test right there, a cop could sit him down and watch him for 20 minutes. Results from breathalizers cannot be admitted as evidence if there's a possibility that a foreign object was in the mouth (Food, drink, etc... putting a nickel in your mouth will "numb" the breathalizer, for example) less than 20 minutes prior. The officer then could have used that time to entertain himself by searching his car, etc...

acutally, thats what they used to do. But he said they don't do it anymore because they were having problems with the in-car breathalizers' accuracy, so now they just drag you off to the station. Seems pretty dumb to me.
